Auto insurance company that wants me to pay upfront?
I need general information concerning auto insurance complanies that pay claims directly to the driver. They want me to absorb all costs (repairs, rental, etc.) and then they will issue me a “reimbursement” check. I don’t want reimbursed for something that their insured driver did to me! I just want them to cover all costs associated with the claim! What, if any, legal action can I take to have the matter proceed in my favor?

You don’t need legal action, you just need to speak with the adjuster handling the claim. If you insisted that they pay the claim immediately they may have suggested paying for all costs yourself and then after they were done with their investigation of the accident they would reimburse you.
Call the adjuster back and speak with them regarding the claim. If you still need help, call your own insurance agent for advice blb

If you have collision coverage on your vehicle, you can go through your insurance company and then pay your deductible. Then your insurance company will go after the other company. If you have liability only, you should be able to wait until they have determined fault and are willing to pay the body shop. Now, if you are wanting to go to your own body shop, that may be another reason that they are wanting you to fix it and reimburse you. What’s the big deal? They’re going to reimburse you. Sure it’s inconvenient but in the end they’re paying. Just remember you have a duty to mitigate your damages which means paying for your repairs & rental costs upfront if need be & being reimbursed later, or have your insurance do it on your behalf assuming you have the proper coverage. If you wanted to sue, you’d still have to incur the expense first. bundysmom
